Right of withdrawal

As of: July 2026

Reading aid. This English version is provided for convenience only. The German version is the legally binding text.

This information on the right of withdrawal specifies the terms of working with ASCENSUS. Pursuant to § 5 of our Terms & conditions, this right of withdrawal applies to clients who act as consumers within the meaning of § 13 BGB (German Civil Code).

Definitions

Coach: A natural or legal person who provides professional coaching services. This includes individuals, companies or organisations acting under a service contract.

Client: The person who uses coaching services. Consumers are natural persons who use the services for private purposes (§ 13 BGB). Entrepreneurs (§ 14 BGB) who obtain the services in the course of their commercial or professional activity are not granted a right of withdrawal by law in Germany.

Right of withdrawal

Consumers within the meaning of § 13 BGB with whom a contract is concluded outside the coach’s business premises have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded or from receipt of proper information on the right of withdrawal.

You exercise the right of withdrawal by making an unambiguous statement informing us of your decision to withdraw from the contract. The statement must be addressed to:

ASCENSUS – Owner Patrick Spengler Buber-Neumann-Weg 32
60439 Frankfurt am Main
Email: patrick@ascensus.fit

You may use the model withdrawal form below for this, but it is not mandatory. To meet the withdrawal period, it is sufficient to send your notice of exercising the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you effectively withdraw from the contract, we must reimburse all payments we have received from you without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement we use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees because of this reimbursement.

Note on compensation for services rendered

If you have requested that the services begin before the withdrawal period expires, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of withdrawal, compared with the total scope of the services provided for in the contract (§ 357a BGB).

Note on premature expiry of the right of withdrawal

If you have requested that the services begin before the withdrawal period expires and have confirmed your awareness that you lose your right of withdrawal upon full performance of the contract, the right expires if the service had already been fully provided at the time of withdrawal (§ 356 (4) BGB).

Your statement on the early start of the service can be made either in writing or by ticking a checkbox by which you request that the service begin during the withdrawal period. It may read as follows:

Being aware of the information on the right of withdrawal, I expressly request that ASCENSUS begin the service before the withdrawal period expires. I am aware that I am obliged to pay for services provided up to the time of withdrawal (§ 357a BGB) and that I lose my right of withdrawal upon full performance of the contract (§ 356 (4) BGB).
